This privacy policy (“Policy”) describes how Kaneka North America, LLC and its related companies  (“Company,” “Kaneka,” “we,” “us,” or “our”) collect, use, and share Personal Information of users (“user,” “you” or “your”) of this website (ubiquinol.org).

“Personal Information” includes information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual consumer or household, such as a name, address, email address, phone number, or any other identifier that facilitates contacting a specific individual by physical or digital means. Personal Information is information concerning a user that a Site or online service collects online from the user and maintains in personally identifiable form and does not include publicly available, de-identified, or aggregated consumer information.

The Company is solely responsible for determining what Personal Information is collected, the purposes for which it is collected, and how it is to be processed and/or used, except for instances where applicable state and/or federal laws dictate the type, purpose, method of processing, and/or use of Personal Information.

Your use of our Site is at all times subject to this Policy and the Site’s Terms and Conditions of Use (“Terms”) Terms of Use. By using our Site, you agree to our Policy and the Terms, and consent to our collection, use, and disclosure of your Personal Information as described in this Policy.

By using this Site and submitting Personal Information to Kaneka, you consent to our collection, use, and processing of your Personal Information as described in this Policy. Please note that the products and services offered on this Site are intended for users who reside in the United States. Information that we may collect from you in connection with your use of this Site will be processed in accordance with federal and state laws of the United States. If you visit our Site from a country outside the United States, please note that the data protection laws in the country in which you reside may be different from the data protection requirements in the United States.

1. WHAT WE COLLECT

We collect Personal Information about you in a number of ways. We use Personal Information collected from you via our Site for the business purposes described in Section 2. Kaneka processes your Personal Information for these purposes based on our legitimate business interests, to enter or perform a contract with you, and/or for compliance with legal obligations.

The specific means by which we acquire Personal Information are as follows:

Information You Give Us. We collect your name, email address, phone number, username, password, demographic information (such as your gender and occupation), and other information you directly give us on our Site. By giving us your email address you are giving us permission to send you marketing messages. Details regarding how to unsubscribe from such messages are provided in Section 6.

Information We Get from Others. We may get information about you from other sources. We may add this to information we get from this Site.

Information Automatically Collected. We may automatically log information about you and your computer. For example, when visiting our Site, we log your computer operating system type, browser type, browser language, the website you visited before browsing to our Site, how long you spent on a page, access times, Internet protocol (IP) address, and information about your use of and actions on our Site.

Cookies. We may log information using "cookies." Cookies are small data files stored on your hard drive by a website. Cookies help us make our Site and your visit better. We use cookies to see which parts of our Site people use and like and to count visits to our Site. Cookies do not read any information on your personal computer, rather, they’re used as identifiers by our Site to customize, monitor, or control the use of the Site based on information stored on the host server.

Web Beacons. We may log information using digital images called Web beacons on our Site or in our emails. We use Web beacons to manage cookies, count visits, and to learn what marketing works and what does not. We also use Web Beacons to tell if you open or act on our emails.

We will only keep your Personal Information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as for tax, accounting or other legal requirements). When we have no legitimate business need to process or maintain your Personal Information, we will either delete or anonymize it, or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible.

Our Site is a general audience Site that is neither designed nor intended to collect Personal Information from children or anyone under the age of 16. Children under the age of 16 should not send us any personal data, including email addresses. Kaneka does not knowingly share the Personal Information of consumers under 16 years of age. If you are under the age of 16 and would like to contact us, please ask your parent or legal guardian to contact Kaneka on your behalf. We ask that parents supervise their children while online. If Kaneka becomes aware that we have received Personal Information pertaining to persons under 16, we will promptly attempt to obtain parental consent or delete the Personal Information from our servers. Kaneka cares about the safety and privacy of children online and complies with the Children’s Online Privacy Protection Act of 1998 (COPPA). COPPA and its accompanying FTC regulations establish United States federal requirements that protect the privacy of children under 13 years of age using the Internet. We do not knowingly collect any Personal Information from children under the age of 13. If we learn that a child under the age of 13 has provided us with Personal Information, we will delete that information in accordance with applicable laws.

2. USE OF PERSONAL INFORMATION

The Personal Information we collect from you is used to provide you with our products and services in a timely manner. We may also use your Personal Information as follows:

• To operate, maintain, and improve our sites, products, and services.
• To process and deliver marketing communications, newsletters and other information that may be of interest to you, including but not limited to educational materials, recipes, contest entries and rewards.
• To respond to comments and questions and provide customer service.
• To send information including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages.
• To communicate about promotions, upcoming events, and other news about products and services offered by us and our selected partners.
• To link or combine user information with other Personal Information.
• To protect, investigate, and deter against fraudulent, unauthorized, or illegal activity.
• To provide and deliver products and services that customers request.
• To protect and maintain the security and integrity of our site and its infrastructure.
• To comply with legal obligations.

We do not sell or trade any Personal Information to outside parties. However, we may share your information with our trusted partners to communicate on our behalf and for the legitimate purposes detailed below in Section 3 of this Policy.

3. SHARING OF PERSONAL INFORMATION

We may also share your Personal Information as follows:

• With your consent.
• When we do a business deal, or negotiate a business deal, involving the sale or transfer of all or a part of our business or assets. These deals can include any merger, financing, acquisition, bankruptcy transaction or proceeding, among other similar transactions.
• For legal, protection, and safety purposes.
• To comply with applicable laws.
• To respond to lawful requests and legal processes.
• To protect the rights and property of Kaneka North America, LLC, our agents, customers, and others. This includes enforcing our agreements, policies, and terms of use.
• In an emergency. This includes protecting the safety of our employees and agents, our customers, or any person.
• With those who need it to do work for us in connection with the legitimate uses described in the Policy.

4. STATE LAW CONSUMER PRIVACY RIGHTS

Some states provide consumers with specific rights regarding the collection and use of their Personal Information.  This section describes these rights and how they can be exercised.

For purposes of this section, the following definitions apply:

(a) “Advertising and Marketing” means a communication by a business or a person acting on the business’ behalf in any medium intended to induce a consumer to obtain goods, services, or employment.

(b) “Aggregate Consumer Information” means information that relates to a group or category of consumers, from which individual consumer identities have been removed, that is not linked or reasonably linkable to any consumer or household, including via a device. “Aggregate Consumer Information” does not mean one or more individual consumer records that have been de-identified.

(c) “Business Purpose” means the use of Personal Information for the business’s operational purposes, or other notified purposes, or for the service provider’s or contractor’s operational purposes, provided that the use of Personal Information shall be reasonably necessary and proportionate to achieve the purpose for which the Personal Information was collected or processed or for another purpose that is compatible with the context in which the Personal Information was collected.

(d) “Consent” means any freely given, specific, informed, and unambiguous indication of the consumer’s wishes by which the consumer, or the consumer’s legal guardian, a person who has power of attorney, or a person acting as a conservator for the consumer, including by a statement or by a clear affirmative action, signifies agreement to the processing of Personal Information relating to the consumer for a narrowly defined particular purpose. Acceptance of a general or broad terms of use, or similar document, that contains descriptions of Personal Information processing along with other unrelated information, does not constitute Consent. Hovering over, muting, pausing, or closing a given piece of content does not constitute Consent. Likewise, agreement obtained through use of dark patterns does not constitute Consent.

(f) “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal Information includes, but is not limited to the following, if it identifies, relates to, describes, is reasonably capable of being associated with, or could be reasonably linked, directly or indirectly, with a particular consumer or household:

(A) Identifiers such as a real name, alias, postal address, unique personal identifier, online identifier, internet protocol address, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers.

(B) Any information that identifies, relates to, describes, or is capable of being associated with, a particular individual, including, but not limited to, his or her name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information. “Personal information” does not include publicly available information that is lawfully made available to the general public from federal, state, or local government records.  

(C) Characteristics of protected classifications under California or federal law.

(D) Commercial information, including records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

(F) Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with an internet website, application, or advertisement.

(G) Geolocation data.

(H) Audio, electronic, visual, thermal, olfactory, or similar information.

(I) Professional or employment-related information.

(J) Education information, defined as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. Sec. 1232g; 34 C.F.R. Part 99).

(K) Inferences drawn from any of the information identified in this subdivision to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behaviors, attitudes, intelligence, abilities, and aptitudes.

(g) “Sensitive Personal Information” is defined as Personal Information that reveals:

(i) A consumer’s social security, driver’s license, state identification card, or passport number.

(ii) A consumer’s account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account.

(iii) A consumer’s precise geolocation.

(iv) A consumer’s racial or ethnic origin, religious or philosophical beliefs, or union membership.

(v) The contents of a consumer’s mail, email, and text messages unless the business is the intended recipient of the communication.

(h) Exclusions from Personal Information. Personal Information does not include publicly available information. For purposes of this subparagraph, “publicly available” means information that is lawfully made available from federal, state, or local government records. Additionally, Personal Information does not include consumer information that is deidentified or Aggregate Consumer Information.

(i) “Verifiable Consumer Request” means a request that is made by a consumer, by a consumer on behalf of the consumer’s minor child, by a natural person or a person registered with the Secretary of State, authorized by the consumer to act on the consumer’s behalf, or by a person who has power of attorney or is acting as a conservator for the consumer, and that the business can verify, using commercially reasonable methods.

A. THE RIGHT TO KNOW ABOUT THE PERSONAL INFORMATION WE COLLECT AND/OR SHARE, AND DATA PORTABILITY RIGHTS

The following table includes categories of Personal Information we collect and have collected during the past 12 months, how this information is collected, why it is collected, and how it is used. We never sell or trade Personal Information.

You may have the right to request that we disclose to you the specific Personal Information we have collected over the past twelve months by submitting a Verifiable Consumer Request. Instructions on how to submit a Verifiable Consumer Request are provided in Section 4(G) of this Policy. Once we receive, review and confirm such a request, we will disclose to you the following information (where applicable or required by law):

• The categories of Personal Information we collected about you.
• The categories of sources from which we collected your Personal Information.
• The business or commercial purpose(s) for collecting your Personal Information.
• The categories of third parties with whom we share Personal Information.
• The specific pieces of your Personal Information we collected.

If we disclosed your Personal Information for a Business Purpose, we will also disclose:

• The categories of your Personal Information that we disclosed.
• The categories of third parties with whom we shared your Personal Information. We will organize this information by the category or categories of Personal Information for each third party to whom the Personal Information was disclosed.

B. THE RIGHT TO REQUEST DELETION OF PERSONAL INFORMATION

You have the right to request, by way of a Verifiable Consumer Request, that we delete any of your Personal Information that we have collected and retained, subject to the exceptions listed below. Instructions on how to submit a Verifiable Consumer Request are provided in Section 4(G). Once we receive and confirm a request to delete Personal Information, we will delete such information, and direct our trusted partners to do the same, unless an exception applies.

We may deny a deletion request if retaining the relevant information is necessary for us or our service provider(s) to:

• Complete the transaction for which the Personal Information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by the consumer, or reasonably anticipated within the context of a business’ ongoing business relationship with the consumer, or otherwise perform a contract between the business and the consumer.
• Help ensure security and integrity to the extent the use of the consumer’s Personal Information is reasonably necessary and proportionate for those purposes.
• Debug, identify, and repair errors that impair existing intended functionality.
• Exercise free speech, ensure the right of another Consumer to exercise their free speech rights, or exercise another right provided for by law.
• Comply with relevant state or federal laws, including the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the California Penal Code.
• Engage in public or peer-reviewed scientific, historical, or statistical research that conforms or adheres to applicable ethics and privacy laws, when the business’ deletion of the information is likely to render impossible or seriously impair the ability to complete such research, if the consumer has provided informed consent.
• Enable solely internal uses that are reasonably aligned with the expectations of the consumer based on the consumer’s relationship with the business and compatible with the context in which the consumer provided the information.
• Otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which you provided the information.

C. THE RIGHT TO CORRECT INACCURATE PERSONAL INFORMATION

You have the right to request via Verifiable Consumer Request that we correct any Personal Information about you that is inaccurate. Instructions on how to submit a Verifiable Consumer Request are provided in Section 4(G).

D. THE RIGHT TO OPT-OUT OF THE SALE OR SHARING OF PERSONAL INFORMATION

You have the right to direct us to not sell or share your Personal Information to a third party for purposes of cross-context behavioral advertising, which is the targeting of advertising to a consumer based on the consumer’s Personal Information obtained from the consumer’s online activity across numerous websites.

Kaneka currently does not sell or share any users’ Personal Information to third parties for purposes of cross-context behavioral advertising.

E. THE RIGHT TO LIMIT THE USE AND DISCLOSURE OF SENSITIVE PERSONAL INFORMATION

You have the right to direct us to limit the use of any Sensitive Personal Information, as defined in Section 4(A), to purposes that are reasonably necessary to provide requested goods or services, including, but not limited to, purposes related to ensuring the security and integrity of a consumer’s Personal Information, performing services on behalf of the business (e.g., customer service, account maintenance, etc.), activities to verify or maintain the quality or safety of a service or product, and short-term transient uses, including, but not limited to, non-personalized advertising shown as part of a consumer’s current interaction with the business.

F. YOUR RIGHT TO NON-DISCRIMINATION

We will not discriminate against you for exercising any rights set forth in this Policy, meaning that, unless we are otherwise permitted by law, we will not:

• Deny you goods or services.
• Charge you different prices or rates for goods or services, including through the use of discounts or other benefits, or by imposing penalties.
• Provide you a different level or quality of goods or services.
• Suggest that you will receive a different price or rate for goods or services, or a different level or quality of goods or services.

G. EXERCISING YOUR RIGHTS TO ACCESS, DATA PORTABILITY, DELETION, AND/OR CORRECTION VIA VERIFIABLE CONSUMER REQUEST

To exercise the rights described above, please submit a Verifiable Consumer Request to us by contacting us at [email protected] or via mail at 6250 Underwood Road, Pasadena, TX 77507; Attention Kaneka Nutrients. Only you or an authorized agent may make a Verifiable Consumer Request related to your Personal Information.

The following information must be provided by you or your authorized agent for us to process your request:

• The nature of your request.
• Your first and last name.
• Your mailing address.
• Your email address.

The Verifiable Consumer Request must:

• Provide sufficient information for us to reasonably verify the identity of the consumer about whom we collected Personal Information.
• Describe the request with sufficient detail such that we can properly understand and respond to it.

If we cannot verify your identity or your authorized agent’s authority to make a request, or confirm that the Personal Information belongs to you, we will not be able to respond to your request. We will not use any Personal Information that you provide within a Verifiable Consumer Request for anything beyond verifying your identity and responding to the request.

Additional information may be requested to verify your identity and/or process your request.

If you choose to use an authorized agent to submit a request on your behalf, you must provide the agent written permission to do so and the agent must verify their own identity directly with us, in addition to the steps we would take if we processed your request directly. If the agent does not submit proof that they have been authorized to act on your behalf, we may deny their request.

H. HOW WE RESPOND TO VERIFIABLE CONSUMER REQUESTS

When we receive a Verifiable Consumer Request, we confirm receipt within 10 business days and provide information regarding how we will process the request. Typically, we will respond to your request within 45 days of receipt. If additional time to evaluate and fulfill your request is necessary, we will notify you of the extension within the initial 45-day period. The extension may be up to an additional 90 days, taking into account the complexity and number of requests. If we provide a disclosure of your Personal Information in response to your request, it will cover the 12-month period preceding our receipt of your Verifiable Consumer Request and will be made in writing and delivered through your user account, if you have one, or, if not, by mail or electronic means. The disclosure will be provided in a readily accessible format that will allow you to transmit the information from one entity to another without hindrance.

We will not charge a fee to process or respond to your Verifiable Consumer Request unless the request is manifestly unfounded or excessive. Unfounded or excessive requests may be charged a reasonable fee, taking into account the administrative costs of providing the information requested. We may also refuse to act on the request. If we refuse to act on a request, we will notify you of the reason for refusal. We are not required to provide you with your Personal Information more than twice in a 12-month period.

In certain circumstances, we may decline to act on your Verifiable Consumer Request. If your request is denied, you have the right to appeal the refusal by submitting a request for an appeal to [email protected]. We will respond to any such requests within 45 days. We may extend the response deadline by an additional 45 days, as long as we inform the requestor of the appeal within the original 45-day window. If an appeal is denied, you may submit a complaint to your state attorney general. Please be aware that not all consumer privacy rights are offered in every state.

5. SECURITY OF YOUR PERSONAL INFORMATION

We implement a variety of security measures to help protect your Personal Information from unauthorized access, disclosure, alteration, and destruction, which includes holding your Personal Information on a secured network with limited access. Although we use our best efforts to ensure the security and confidentiality of your Personal Information, no data transmission or storage system can be guaranteed to be 100% secure. Thus, we cannot guarantee or warrant the security of any information you transmit to us and you do so at your own risk. You should only access our Site within a secure environment and you remain solely responsible for the security of your computer at all times.

6. OPTING OUT OF COMMUNICATIONS AND COOKIES

You may opt out of receiving marketing messages by sending an email request to [email protected]. Each marketing email we send to you will also contain a link where you can unsubscribe from such messages. If you opt out of receiving marketing messages, we may still send you non-marketing emails for the legitimate business purposes described in this Policy. Non-marketing emails include emails about your accounts and our business dealings with you.

As explained in Section 1, our Site uses cookies to collect information regarding how our Site is used. You can typically remove and reject cookies from our Site in your browsers settings. Many browsers are set to accept cookies until you change this default setting. Removing or rejecting cookies may affect how our Site works for you.
